Long-Term Care Services Act Article 47

A long-term care institution found in any of the following circumstances shall be fined between NT$60,000 and NT$300,000, and the name of the institution and its person-in-charge shall be publicly disclosed:1. Violating Article 23 by expanding or relocating without the permission of the competent authority.2. Violating Paragraph 1 of Article 34 by failing to maintain public accident liability insurance.3. Violating Paragraph 1 of Article 41 by failing to provide appropriate referrals or placement for service users, or failing to cooperate with the competent authority’s referral and placement measures.4. Violating Article 44 by committing acts of abandonment, physical or mental abuse, discrimination, injury, illegal restriction of personal freedom, or other infringements upon the rights and interests of service users.For violations of Subparagraphs 1 or 2 of the preceding paragraph, the institution shall be fined and publicly disclosed, and ordered to rectify the violation within a specified time limit; those who fail to rectify by the deadline may be fined consecutively for each instance.For violations of Subparagraph 4 of the first paragraph, the institution shall be fined and publicly disclosed, and ordered to rectify within a specified time limit; those who fail to rectify by the deadline shall be subject to a suspension of operations for a period of one month to one year. If the violation is still not rectified upon the expiration of the suspension period, their establishment permit may be revoked.In cases where a violation of Subparagraph 4 of the first paragraph is deemed severe, the competent authority may directly revoke the institution's establishment permit.
