Marine Pollution Control Act Enforcement Rules Article 14
Those engaged in offshore wind power generation projects shall submit an emergency response plan pursuant to Article 15, Paragraph 1 of this Act, which shall include the following items in the measures to be taken during the construction and maintenance and operation periods according to the progress of the project:1. Construction period:A. Alert and notification methodsB. Resolution methods for operating abnormalities, malfunctions and accidentsC. Pollutant cleanup and harm mitigation methodsD. Circumstances that require the suspension of operation, dumping or the reduction of outputE. All devices and equipment that are required for emergency response workF. Duty assignment and training regulations for participating response personnelG. Other items designated by the central competent authority2. Maintenance and Operation Period:A. Establishment of a maintenance and operation control mechanism to manage entry and exit the maintenance zone and related safety regulations, and to propose a regional joint defense content for adjacent operational units.B. Alert and notification methodsC. Procedures for stopping operations, handling operational anomalies, faults, and accidental incidents.D. Pollutant cleanup and harm mitigation methodsE. All devices and equipment that are required for emergency response workF. Duty assignment and training regulations for participating response personnelG. Establishment of remote monitoring mechanisms and preventive measures against pollution.H. Proposal of mitigation measures or alternative solutions.I. Other items designated by the central competent authority
中文原文 海洋污染防治法施行細則第14條
從事離岸風力發電工程者，依本法第十五條第一項提出之緊急應變計畫，依工程進度區分施工期間及維運期間之措施，其內容應分別包含下列事項：
一、施工期間：
（一）警報、通報方式。
（二）施工進行操作異常、故障及意外事故排除方法。
（三）污染物或設施施工及耗損造成廢棄物之清理及減輕危害方法。
（四）須停止施工之情形。
（五）應變所需之器材、設備。
（六）參與應變人員之任務編組及其訓練規定。
（七）其他經中央主管機關指定之事項。
二、維運期間：
（一）成立維運控制機制，控管維運範圍之進出及相關安全規定，並提出與鄰近營運單位之區域聯防內容。
（二）警報、通報方式。
（三）停止操作之情形、操作異常、故障及意外事故排除方法。
（四）污染物或設施營運耗損造成廢棄物之清理及減輕危害方法。
（五）應變所需之器材、設備。
（六）參與應變人員之任務編組及其訓練、演練規定。
（七）建立遠端監測機制及預防污染措施。
（八）提出之衝擊減輕措施或替代方案。
（九）其他經中央主管機關指定之事項。
