Regulations for Tuna Longline Fishing Vessels Operating in the Maritime Area Subject to the Fisheries Agreement between Taiwan and Japan Article 14
In the event of any of the following circumstances, pursuant to Article 10 of the Act, the fishing license of the concerned fishery operator and the certificate of fishing vessel officer or the fishing vessel crew identification of the concerned fishery employee(s) shall be suspended for a period of not more than one year; where the violation is considered serious, the fishing license of fishery operator and the certificate of fishing vessel officer or the fishing vessel crew identification of the fishery employee(s) may be withdrawn:Fishing in the Taiwan-Japan Area without a permit, in violation of Article 3.Violating any restriction on catch amount as promulgated pursuant to Article 6, paragraph 2.Failing to maintain the automatic location communicator functional year-round, in violation of Article 9, paragraph 1.Failing to have the automatic location communicator installed on board confirmed functional before port departure, and failing to report vessel position(s), in violation of Article 9, paragraph 2.Failing to return to a port within the specified timeframe, or leaving a port without having the automatic location communicator repaired, in violation of Article 9, paragraph 4.Switching off the automatic location communicator installed on board without applying for permission, in violation of Article 9, paragraph 5.Landing in any port other than the designated ports, in violation of Article 10.Violating any provision on fishing operations in the Taiwan-Japan Area as stipulated in Article 11; Article 12, subparagraph (1); Article 12, subparagraph (2), item i and ii; or Article 13.

有下列情形之一者，得依本法第十條規定，收回漁業人漁業證照、漁業從業人幹部船員執業證書或漁船船員手冊一年以下之處分；情節重大者，得撤銷漁業人漁業證照、漁業從業人幹部船員執業證書或漁船船員手冊：
一、違反第三條規定，未經許可擅赴台日海域作業。
二、違反第六條第二項公告漁獲量限制規定。
三、違反第九條第一項規定，未維持船位回報器全年正常運作。
四、違反第九條第二項規定，未確認船位回報器正常運作，即擅自出港。
五、違反第九條第四項規定，未於指定期限內返港，或未完成修復船位回報器即擅自出港。
六、違反第九條第五項規定，未經核准即擅自關閉船位回報器。
七、違反第十條規定，在指定漁港以外卸魚。
八、違反第十一條、第十二條第一款、第二款第一目、第二目或第十三條所定於台日海域作業應遵守作業規定之一。

三、違反第九條第一項規定，未維持船位回報器全年正常運作。
四、違反第九條第二項規定，未確認船位回報器正常運作，即擅自出港。
