Regulations Governing the Management of Collective Trust Funds Article 44
A trust supervisor shall act with due care of a good manager to represent all beneficiaries in carrying out the following duties:1. Take litigious or non-litigious actions regarding the trust in his/her/its own name on behalf of the beneficiaries.2. When the trustee is derelict in its duties or has other serious situations, petition to the court at the request of the beneficiaries to discharge the trustee and appoint a new one.3. At the request of the beneficiaries, take necessary actions in the interests of the beneficiaries.4. Take other necessary actions pursuant to laws and regulations in the interests of the beneficiaries.

信託監察人應以善良管理人之注意義務，代表全體受益人執行下列職責：
一、以自己名義為受益人為有關信託之訴訟上或訴訟外之行為。
二、受託人有違背其職務或其他重大事由時，經受益人之請求，得聲請法院將其解任並選任新任受託人。
三、經受益人之請求，為受益人之利益所為必要之行為。
四、其他依法令之規定，為受益人之利益所為必要之行為。
