Regulations on the Management of Crew Members of Fishing Vessels Article 8
The employment and compensation package of any crew shall be specified in a written employment contract between the concerned fishery operator and crew. The contract shall specify the following:1. Name, birth date and year, place of birth, national identification number or other identification document and the number thereof, of the fishery operator and crew.2. Date and location of signing the contract.3. Name and number of the fishing vessel concerned and the position assumed.4. Fishing area.5. Wage amount and payment method(s).6. Provision of safety equipment and supplies for crew when working onboard.7. Rest and leave(s).8. Type(s) of insurance(s) taken out and the amount thereof.9. Condition(s) for the termination of the contract.10. Validity period of the contract.11. Other agreed matter(s).The fishery operator and crew shall each hold an original copy of the employment contract as referred to in the preceding paragraph.The template for the employment contract as referred to in paragraph 1 is announced by the central competent authority.In case that other laws and regulations provide for the employment and compensation package for Mainland China crew, foreign crew employed overseas, and foreign crew introduced pursuant to the Employment Service Act, such laws and regulations shall prevail.

船員之僱用及待遇，應由漁業人與船員雙方訂立書面勞動契約；其契約應載明下列事項：
一、漁業人及船員之姓名、出生年月日、出生地、國民身分證統一編號或其他身分證明文件及編號。
二、締約日期及地點。
三、服務之漁船名稱、編號及擔任職務。
四、作業漁場區域。
五、薪資數額及給付方式。
六、提供船員船上工作安全設備及生活物資。
七、休息及休假。
八、投保保險種類及保險金額。
九、契約終止條件。
十、契約有效期間。
十一、其他約定事項。
前項勞動契約正本，漁業人與船員應各執一份。
第一項勞動契約範本，由中央主管機關公告之。
大陸船員、境外僱用非我國籍船員及依就業服務法引進之外國籍船員之僱用及待遇，其他法規另有規定者，從其規定。
