Depending on the quota utilization in the current year, the competent authority may announce the additional quota that can be applied for.Any saury fishing vessel that meets the following requirements may apply for the additional quota as referred to in the preceding paragraph:(1) Its available quota shall be 80% of the individual vessel initial quota announced pursuant to Article 12-2, paragraph 1.(2) Its saury catch amount has reached 80% of and not exceeded its available quota.In case that a saury fishing vessel is under any of the following circumstances, the competent authority shall not grant the additional quota as referred to in paragraph 1:(1) Its catch amount of species with catch limit in the preceding year exceeds 10% or above of its available quota of that year.(2) Its available quota, after the allocation of the additional quota, exceeds the maximum as announced pursuant to Article 12-2, paragraph 1.The additional quota acquired in accordance with paragraph 1 shall not be transferred.

主管機關得視當年度漁獲配額使用情形，公告可申請分配之配額。
秋刀魚漁船符合下列規定者，得申請前項配額：
一、秋刀魚漁船單船可用配額應達第十二條之二第一項公告之單船初始配額百分之八十。
二、秋刀魚漁船漁獲量達單船可用配額百分之八十，且未超過單船可用配額。
有下列情形之一者，主管機關不予核給第一項之配額：
一、前一許可年度配額限制魚種之漁獲量，超過該年度單船可用配額百分之十以上。
二、分配後單船可用配額超過依第十二條之二第一項規定所公告之上限。
申請取得之第一項配額，不得轉讓。
