Water Act Article 55
When a water work proprietor develops new water sources for waterway in connection with a hydraulic construction, said proprietor has the priority to apply for right of use and collecting income derived from the water source, provided the vested interests in water use of the downstream water right holders are not affected.The vested interests as referred to in the preceding paragraph shall mean the natural flow of water not exceeding the volume under the registered water right before the new water sources are developed.

興辦水利事業人因投資興辦水利建造物而增闢水道之水源者，在不影響下游水權人既得用水權益時，其增闢之水源，興辦水利事業人有優先申請使用收益之權。
前項既得用水權益，指未增闢水源前之自然流量，但以不超過其登記之水權為限。
