Enforcement Rules of the Patent Act Article 24
In the event that parts of the description or the drawing(s) are missing from the patent application for invention, the filing date shall be the date on which the missing parts of the description or the drawing(s) are filed. However, the filing date shall be the date on which the application was first filed under any of the following conditions:1. where the application claims priority of an earlier application, and the missing parts of the description or the drawing(s) are completely contained in the earlier application; or2. where the applicant withdraws the earlier filed missing parts of the description or the drawing(s) within thirty days after being served with a notification confirming the filing date by the Specific Patent Agency.Where the description or drawing(s) referred to in the preceding paragraph is submitted in a foreign language, the above provisions shall apply.

發明專利申請案之說明書有部分缺漏或圖式有缺漏之情事，而經申請人補正者，以補正之日為申請日。
但有下列情事之一者，仍以原提出申請之日為申請日：
一、補正之說明書或圖式已見於主張優先權之先申請案。
二、補正之說明書或圖式，申請人於專利專責機關確認申請日之處分書送達後三十日內撤回。
前項之說明書或圖式以外文本提出者，亦同。
但有下列情事之一者，仍以原提出申請之日為申請日：
一、補正之說明書或圖式已見於主張優先權之先申請案。
二、補正之說明書或圖式，申請人於專利專責機關確認申請日之處分書送達後三十日內撤回。
前項之說明書或圖式以外文本提出者，亦同。
