Where the execution of a punishment has been commuted to imprisonment in accordance with the Former Criminal Code, the period of such imprisonment shall not exceed six months from the day on which the Criminal Code is enforced.Where, after the enforcement of the Criminal Code, a fine is paid within the period of the imprisonment to which the execution of a punishment is commuted, the number of days of imprisonment shall be reduced in proportion to the amount paid and in accordance with the standard fixed by the judgment .

依舊刑法易科監禁者，其監禁期限，自刑法施行之日起，不得逾六個月。
其在刑法施行後易科監禁期限內納罰金者，以所納之數，仍依裁判所定之標準扣除監禁日期。
