An agricultural right holder is not entitled to lease out the land or other agricultural works to another person. However if the lease upon agricultural works is otherwise provided by custom, such custom shall be followed.If the agricultural right holder violates the provision of the preceding paragraph, the landowner is entitled to terminate the agricultural right.

農育權人不得將土地或農育工作物出租於他人。
但農育工作物之出租另有習慣者，從其習慣。
農育權人違反前項規定者，土地所有人得終止農育權。
