Regulations for Invitation to Tender and Award of Contract in Special Procurement Article 6-1
The acquisition of property or service between governmental entities pursuant to subparagraph 3 of paragraph 1 of Article 105 of the Act shall be in conformity with one of the following circumstances: 1. where the subject of acquisition cannot be manufactured or supplied by common suppliers;2. where the subject of acquisition is required for national security or confidentiality;3. where no tender, offer or proposal in writing from suppliers is received after a public notice has been given in accordance to the Act;4. where the procurement is of a value not reaching the threshold for publication; or5. other circumstances as prescribed by the responsible entity.

公務機關間財物或勞務之取得，依本法第一百零五條第一項第三款辦理者，應符合下列情形之一：
一、非屬一般廠商所能製造或供應者。
二、於國家安全或機密有必要者。
三、依本法辦理公告結果，無廠商投標或提供書面報價或企劃書者。
四、未達公告金額之採購。
五、其他經主管機關認定者。
