A guard, sentry, or a person who takes the duties of guarding on the alert, transmitting or dispatching orders makes unauthorized absence or departure form the duty shall be punished with imprisonment for not more than one year, detention, or a fine of not more than 100,000 yuan. If the offence caused the injury to the military shall be punished with imprisonment for life or imprisonment for not less than one year and not more than seven years.A person who commits the offences in the preceding paragraphs unpremeditatedly and caused the injury to the military shall be punished with imprisonment for not more than six months, detention, or a fine of not more than 50,000 yuan.A person who commits the offences in the first paragraphs in wartime shall be punished with imprisonment for not more than five years. If the offence caused the injury to the military shall be punished with imprisonment for life or imprisonment for not less than one year and not more than seven years.A person who commits the offences in the first paragraph unpremeditatedly in wartime shall be punished with imprisonment for not more than three years, detention, or a fine of not more than 300,000 yuan.

衛兵、哨兵或其他擔任警戒、傳令職務之人，不到或擅離勤務所在地者，處一年以下有期徒刑、拘役或新臺幣十萬元以下罰金；致生軍事上之不利益者，處一年以上七年以下有期徒刑。
因過失犯前項前段之罪，致生軍事上之不利益者，處六月以下有期徒刑、拘役或新臺幣五萬元以下罰金。
戰時犯第一項前段之罪者，處五年以下有期徒刑；致生軍事上之不利益者，處無期徒刑或七年以上有期徒刑。
戰時因過失犯第一項前段之罪者，處三年以下有期徒刑、拘役或新臺幣三十萬元以下罰金。
因過失犯前項前段之罪，致生軍事上之不利益者，處六月以下有期徒刑、拘役或新臺幣五萬元以下罰金。
戰時犯第一項前段之罪者，處五年以下有期徒刑；致生軍事上之不利益者，處無期徒刑或七年以上有期徒刑。
戰時因過失犯第一項前段之罪者，處三年以下有期徒刑、拘役或新臺幣三十萬元以下罰金。
