Criminal Code of the Armed Forces Article 34
A guard, sentry, or a person who takes the duty of guarding on the alert neglects the duty for sleep, drunkenness or other similar situations and causes injury to military interests shall be punished with imprisonment for not more than five years. A person who commits the offence in the preceding paragraph in wartime shall be punished with imprisonment for not less than one year and not more than seven years; if the offence causes the injury to the military shall be punished with imprisonment for life or imprisonment for not less than seven years.A person who commits the offences in the first paragraphs unpremeditatedly in wartime shall be punished with imprisonment for not more than three years, detention, or a fine of not more than 300,000 yuan.

衛兵、哨兵或其他擔任警戒職務之人，因睡眠、酒醉或其他相類之情形，而廢弛職務，足以生軍事上之不利益者，處五年以下有期徒刑。
戰時犯前項之罪者，處一年以上七年以下有期徒刑；致生軍事上之不利益者，處無期徒刑或七年以上有期徒刑。
戰時因過失犯第一項之罪者，處三年以下有期徒刑、拘役或新臺幣三十萬元以下罰金。
