Act of Assignment for Officers And Noncommissioned Officers of the Armed Force Article 10
Where Military Officers have any of the following situations shall be dismissed：Subparagraph 1Being finally and irrevocably sentenced to an imprisonment for a definite period or a more severe punishment, and not on probation or permitted to commute the sentence to payment of a fine.Subparagraph 2Being finally and irrevocably judged to a rehabilitative measure, under observation for rehabilitation and force rehabilitation, but excluding protection custody.Subparagraph 3Wanted for a crime.Subparagraph 4Be dismissed in accordance with Act of Punishment of the Arm Forces .Subparagraph 5Other major reasons that need to be dismissed.

軍官、士官有下列情形之一者，撤職：
一、受有期徒刑以上刑之判決確定，而未宣告緩刑或未准易科罰金。
二、受保安處分、觀察、勒戒或強制戒治裁判確定。
但付保護管束者，不在此限。
三、因案通緝。
四、依陸海空軍懲罰法規定應撤職。
五、其他重大原因必須撤職。
