Police Personnel Management Act Article 10-1

Persons subject to the provisions of Article 6 shall not be appointed in any of the following circumstances:1. Those who have violated any of the provisions set forth in Paragraph 1, Article 28 of the Civil Service Employment Act.2. Those who have been dismissed from the civil service in accordance with the Civil Service Performance Evaluation Act, removed from office in accordance with the Public Officials’ Discipline Act, or dismissed from office for other violations of the law.3. Those listed as individuals for which there are public safety concerns in accordance with any subparagraph of Paragraph 1, Article 15 of the Police Powers Exercise Act.4. Those who have been convicted of crimes specified in Article 268 of the Criminal Code, Article 267 of the Criminal Code as amended before July 1, 2006, or Article 350 of the Criminal Code, with conviction affirmed.5. Those who have been put in pre-trial detention or wanted under criminal procedural law.6. Those expelled or who have had their enrollment revoked from the Central Police University, Central Police College, Taiwan Police College or military academies.7. Those found ineligible to serve as a public servant under other relevant laws.If any of the circumstances listed in the preceding paragraph are discovered after the appointment of a police officer, the appointment shall be revoked.The handling of the duties, salaries, and the results of the background check of personnel whose appointments are revoked pursuant to Paragraph 1, Article 6 shall be conducted in accordance with the provisions of the Public Service Employment Act.
