Civil Service Protection Act Article 22

While a civil servant is involved in a lawsuit for performing duties in accordance with laws, the government agency he/she serves shall assist in retaining lawyers to defend him/her and providing legal aid.If the lawsuit in the preceding paragraph is caused by the intentionality or gross negligence of the civil servant, there shall be no assistance. If the agency where he/she serves has paid for lawyer’s fee, it shall claim for reimbursement against him/her.The regulation with respect to the assistance to a civil servant involved in a lawsuit in Paragraph 1 shall be promulgated jointly by the Examination Yuan and the Executive Yuan.
中文原文 公務人員保障法第22條
公務人員依法執行職務涉訟時，服務機關應輔助其延聘律師為其辯護及提供法律上之協助。
前項情形，其涉訟係因公務人員之故意或重大過失所致者，應不予輔助；如服務機關已支付涉訟輔助費用者，應予追還。
第一項之涉訟輔助辦法，由考試院會同行政院定之。
