The records referred to in the preceding two articles shall be prepared by a clerk who is present; the public official who asks questions or conducts the search, seizure, or inspection shall affix his signature on the records; in the absence of a clerk, the public official who asks questions or conducts the search, seizure, or inspection may either personally prepare the records, or appoint another on duty public official who is present to do it.Note: Articles 1 through 343 were amended lastly on February 6, 2003.
中文原文 刑事訴訟法第43條
前二條筆錄應由在場之書記官製作之。
其行訊問或搜索、扣押、勘驗之公務員應在筆錄內簽名；如無書記官在場，得由行訊問或搜索、扣押、勘驗之公務員親自或指定其他在場執行公務之人員製作筆錄。
