(Right to File a Motion for Retrial (I) – for Interests of the Convicted)Motion for retrial for interests of the convicted may be filed by the following persons:1. A prosecutor in the competent court;2. The convicted;3. The statutory agent or spouse of the convicted;4. The spouse, lineal blood relatives, collateral blood relatives, relatives by marriage within the second degree of relationship, family head or family members of the convicted, where the convicted is deceased.

為受判決人之利益聲請再審，得由下列各人為之：
一、管轄法院對應之檢察署檢察官。
二、受判決人。
三、受判決人之法定代理人或配偶。
四、受判決人已死亡者，其配偶、直系血親、三親等內之旁系血親、二親等內之姻親或家長、家屬。
