(Reverse the Original Judgment (I) - Adjudication)Where an original judgment is reversed pursuant to the following circumstances, the court of third instance shall adjudicate the case; provided that this rule does not apply to judgments to be made pursuant to the latter two articles:1. Where in contravention of laws or regulations does not affect the finding of facts and can be the basis of judgment;2. Where an exempt from prosecution or case dismissed shall be pronounced;3. Where a circumstance under Subparagraph 4 or 5 of Article 393 exists.

第三審法院因原審判決有左列情形之一而撤銷之者，應就該案件自為判決。
但應為後二條之判決者，不在此限：
一、雖係違背法令，而不影響於事實之確定，可據以為裁判者。
二、應諭知免訴或不受理者。
三、有第三百九十三條第四款或第五款之情形者。
