The application for setting the case for trial may be withdrawn prior to the court ruling is made; the same can be done after the ruling setting the case for trial has been made but prior to the conclusion of argument at the trial of the first instance.The clerk shall immediately notify the accused of the withdrawal of application for setting the case for trial.The person who withdraws the application for setting case for trial may not re-apply the same.Note: Articles 1 through 343 were amended lastly on February 6, 2003.
