If a statutory agent of the victim or if the spouse, blood relative within the fourth degree of kinship, relative by marriage within the third degree of relationship, family head, or family member of such statutory agent is the accused, the victim's lineal blood relative, collateral blood relative within the third degree of kinship, relative by marriage within the second degree of relationship, family head, or family member may independently file a complaint.Note: Articles 1 through 343 were amended lastly on February 6, 2003.

被害人之法定代理人為被告或該法定代理人之配偶或四親等內之血親、三親等內之姻親或家長、家屬為被告者，被害人之直系血親、三親等內之旁系血親、二親等內之姻親或家長、家屬得獨立告訴。
