A statutory agent or spouse of the victim may file an independent complaint.If a victim is dead, a complaint may be filed by spouse, lineal blood relative, collateral blood relative within the third degree of kinship, relative by marriage within the second degree of relationship, family head, or family member, provided that the complaint may not be contrary to the clearly expressed opinion of the victim in a case chargeable only upon complaint.Note: Articles 1 through 343 were amended lastly on February 6, 2003.

被害人之法定代理人或配偶，得獨立告訴。
被害人已死亡者，得由其配偶、直系血親、三親等內之旁系血親、二親等內之姻親或家長、家屬告訴。
但告訴乃論之罪，不得與被害人明示之意思相反。
