Code of Civil Procedure Article 261
A claim may be amended, and an additional claim and counterclaim may be raised in the oral-argument sessions.The amendment or addition of claims, or counterclaims made in the oral-argument sessions shall be indicated in the oral-argument transcript. The transcript shall be served on the opposing party when the opposing party was not present.

訴之變更或追加及提起反訴，得於言詞辯論時為之。
於言詞辯論時所為訴之變更、追加或提起反訴，應記載於言詞辯論筆錄；如他造不在場，應將筆錄送達。
