Code of Civil Procedure Article 260
No counterclaim may be raised if it is subject to the exclusive jurisdiction of another court or if it is neither related to the plaintiff's claim nor related to the defendant's means of defense.No counterclaim may be raised if it cannot be adjudicated in the same proceeding with the plaintiff's claim.The court may dismiss a counterclaim without prejudice where it is raised by a party for purposes of delaying litigation.

反訴之標的，如專屬他法院管轄，或與本訴之標的及其防禦方法不相牽連者，不得提起。
反訴，非與本訴得行同種之訴訟程序者，不得提起。
