Where the bidder is in any of the circumstances as described in Paragraph 1 of Article 16 during the bidding procedures, the regulatory agency may revoke or abolish its right to participate in the bidding; where the said circumstance is found after the bid has been awarded, the bid award shall be revoked or abolished, and the paid winning bid shall be returned without interest.Under the foresaid circumstance, the posted review fee, tender bond and the interest accrued will not be reimbursed, and one that has been reimbursed shall be retroactively recuperated or have the sum deducted from the bidder’s winning bid.

競價者於競價程序中，有第十六條第一項各款情事之一者，主管機關得撤銷或廢止其參加競價之權利；於得標後始發現者，撤銷或廢止其得標，無息發還已繳納之得標金。
前項情形，已繳納之審查費、押標金及其利息不予發還，已發還者應予追繳或於得標金中扣抵，如有不足，並予追繳。
