Referendum Act Article 26
A local referendum proposal shall be submitted to the municipal or county (city) government.Matters relating to local referendums not provided for in this Act shall be prescribed by the respective special municipalities and counties (cities) by self-government ordinances.If there is any doubt as to whether a referendum proposal pertains to a matter of local self-governance, the municipal or county (city) government shall request a ruling from the Executive Yuan.

公民投票案應分別向直轄市、縣（市）政府提出。
公民投票案相關事項，除本法已有規定外，由直轄市、縣（市）以自治條例定之。
直轄市、縣（市）政府對於公民投票提案，是否屬地方自治事項有疑義時，應報請行政院認定。
