Enforcement Rules of the Trust Enterprise Act Article 7
The business activities that trust enterprises are permitted to engage in as set out in the subparagraphs of Article 16 of the Act shall be classified as follows according to whether or not a trustee has the power to decide the allocation of trust assets:1.Trust in which the trustee has the power to decide the allocation of trust assets: Further classified into the following two categories by whether or not the trustor designates the scope or method for the allocation of the trust assets:(1) Semi-discretionary: The trustor makes a blanket designation of the scope or method for the allocation of the trust assets, and the trustee, within the scope or method so designated, has the power to decide the allocation of the trust assets.(2) Discretionary: The trustor does not designate the scope or method for the allocation of the trust assets, and the trustee, within the scope of the purpose of the trust, has the power to decide the allocation of the trust assets.2.Trust in which the trustee does not have the power to decide the allocation of the trust assets: The trustor retains the power to decide the allocation of the trust assets and stipulates that the trustor or a third party authorized by the trustor will, with respect to the scope or method for the allocation of the trust assets, make specific, particular allocation instructions as to investment instrument, allocation method, dollar amount, conditions, and time period, and the trustee manages or disposes of the trust assets on the basis of those allocation instructions.

本法第十六條各款所定信託業經營之業務項目，依受託人對信託財產運用決定權之有無，分類如下：
一、受託人對信託財產具有運用決定權之信託：依委託人是否指定營運範圍或方法，分為下列二類：
（一）委託人指定營運範圍或方法：指委託人對信託財產為概括指定營運範圍或方法，並由受託人於該概括指定之營運範圍或方法內，對信託財產具有運用決定權。
（二）委託人不指定營運範圍或方法：指委託人對信託財產不指定營運範圍或方法，受託人於信託目的範圍內，對信託財產具有運用決定權。
二、受託人對信託財產不具有運用決定權之信託：指委託人保留對信託財產之運用決定權，並約定由委託人本人或其委任之第三人，對信託財產之營運範圍或方法，就投資標的、運用方式、金額、條件、期間等事項為具體特定之運用指示，並由受託人依該運用指示為信託財產之管理或處分。
