Law:: Enforcement Rule of the Privatization of Government-Owned Enterprises Act
Chinese:: 公營事業移轉民營條例施行細則第12條

The term "employees" referred to in paragraphs 1 to 3 of Articles 8, paragraph 1 of Article 10, paragraphs 1 and 2 of Article 11 and Article 12 of the Act shall mean the personnel to whom the regulations regarding retirement and severance shall apply by law; however, the following personnel are not included:1. Personnel who are engaged under the Contract-based Personnel Employment Act;2. Personnel who are employed by means of contract under the Regulations on Contracted Employment of the Executive Yuan and Its Subordinate Agencies;3. Personnel who are employed under fixed-term labor contracts;4. Personnel on a temporary transfer or part-time basis;5. Personnel on temporary employment.

本條例第八條第一項至第三項、第十條第一項、第十一條第一項、第二項及第十二條所稱從業人員，指依法得適用退休、資遣規定之人員。
但不包括下列人員：
一、依聘用人員聘用條例聘用之人員。
二、依行政院暨所屬機關約僱人員僱用辦法僱用之人員。
三、定期勞動契約人員。
四、借調或兼職人員。
五、其他臨時人員。
