People with Disabilities Rights Protection Act Article 41
People with disabilities qualified for sheltered employment in vocational evaluation are provided with jobs by the agencies/organizations/institutions capable of providing sheltered employment services. Both sides shall sign a written contract under mutual understanding (on the rights, interests, and duties).When people with disabilities accept sheltered employment but are assessed in the vocational evaluation of Article 34 as unfit for the sheltered employment, the sheltered employment service agencies/organizations/institutions shall, according to the factual need of people with disabilities, provide transition service, and may not pay severance.

經職業輔導評量符合庇護性就業之身心障礙者，由辦理庇護性就業服務之單位提供工作，並由雙方簽訂書面契約。
接受庇護性就業之身心障礙者，經第三十四條之職業輔導評量單位評量確認不適於庇護性就業時，庇護性就業服務單位應依其實際需求提供轉銜服務，並得不發給資遣費。
