Medical Care Act Article 107

Those who violate any of the provisionsofParagraph2 of Article 61, Paragraph2 of Article 62, Paragraph1ofArticle 63, Paragraph1ofArticle 64, Article 68, Article 72, Article 78, Article 79, or Paragraph 2 of Article 93 shall be penalized in accordance with the provisions of Article 102, Article 103, or Article 105. In addition, the offender shall also be penalized by said Articles. Persons whose violations involve criminal liability shall be transferred to the juridical authority for disposal.In the event that the offender is a medical person, he/she shall be penalized in accordance with the respective specialty medical profession laws.
中文原文 醫療法第107條
違反第六十一條第二項、第六十二條第二項、第六十三條第一項、第六十四條第一項、第六十八條、第七十二條第一項第一款、第二款、第七十八條、第七十九條或第九十三條第二項規定者，除依第一百零二條、第一百零三條或第一百零五條規定處罰外，對其行為人亦處以各該條之罰鍰；其觸犯刑事法律者，並移送司法機關辦理。
前項行為人如為醫事人員，並依各該醫事專門職業法規規定懲處之。
違反第七十二條第一項第三款及第四款規定者，處三年以下有期徒刑或併科新臺幣三十萬元以下罰金。
違反第七十二條第一項第五款至第七款規定者，處六個月以上五年以下有期徒刑或科或併科新臺幣五十萬元以下罰金。
前項之未遂犯罰之。
違反第七十二條第一項第三款至第七款之附著物及物品，不問屬於犯罪行為人與否，沒收之。
前項行為人如為醫事人員，並依各該醫事專門職業法規規定懲處之。
違反第七十二條第一項第三款及第四款規定者，處三年以下有期徒刑或併科新臺幣三十萬元以下罰金。
違反第七十二條第一項第五款至第七款規定者，處六個月以上五年以下有期徒刑或科或併科新臺幣五十萬元以下罰金。
