Regulations on the Management of Crew Members of Fishing Vessels Article 24
A captain shall be held accountable for affairs relating to safety and management of a fishing vessel and be in charge of the following duties:1. To confirm that Automatic Identification System (AIS), vessel monitoring system (VMS), life-saving appliances, and navigational equipment are functional and seaworthy, and to place the Emergency Position Indicating Radio Beacon (EPIRB) at the designated location before port departure.2. To take stock of food, portable water, and medicine onboard to see if the amount is sufficient before port departure, and in case of insufficiency, to notify the concerned fishery operator for complement.3. To verify if all crew carry a valid Fishing Vessel Crew Identification, Fishing Vessel Foreign Crew Identification, or Certificate of Fishing Vessel Officer, and to confirm if all crew pass the physical examination.4. To supervise and direct all crew to conduct navigation activities and fishery operations. In case of a joint operation, captain(s) of the subsidiary fishing vessel(s) shall obey the command of the captain of the mother fishing vessel.5. To select fishing grounds, decide operation locations, and instruct fishing techniques.6. To have the full knowledge of the structure and functions of the fishing vessel, and at all times to be mindful of relevant safety examinations, maintance, and repair. Any outgoing captain shall hand over the aforementioned knowledge of the fishing vessel and relevant records to the successor.7. To request crew to wear life jackets during fishing operations on deck.8. To proceed with immediate rescue in case of receiving at sea any mayday(s) from other fishing vessel(s), unless the fishing vessel itself is also in distress.9. To immediately notify the Fishery Radio Station in case of distress or accident of the fishing vessel at sea, or injury, sicknees, missing, decease of crew.10. To navigate the fishing vessel to the nearest port as soon as possible for medical treatment or to coordinate with other fishing vessel(s) to send the concerned crew for medical treatment, in case of serious injury or sicknees of crew at sea.11. To assign crew to keep clean and manage the use of the accommodation, kitchen, mess room, toilet(s), and shower room(s).12. To take good care of all statutory proving documents and the crew list of the fishing vessel, and in the case of the fishing vessel as referred to in Article 7, paragraph 2, to also take good care of copies of employment contracts for the inspection of crew.13. To make entries of and examine the deck logbook and fishing logbook at all times.14. To instruct interns and assess their performance.15. To completely and accurately record on the deck logbook the whole story, time, and location in case of any of the following circumstances at sea, and submit such record to the competent navigation and fishery authorities at the port of first arrival of the fishing vessel : 1. The fishing vessel encounters distress and danger. 2. The fishing vesselfinds the collision or distress of other vessel(s). 3. The fishing vessel rescues vessel(s) or person(s) in distress. 4. Any disposition is imposed on any crew for his/her negligence. 5. Any crew onboard is missing, dead, injured, or infected with contagious disease; 6. Any other important matters.16. To prepare a sea protest in accordance with Article 66 of the Seafarer Act.17. To provide observer(s) and inspector(s) with necessary and adequate assistance for carrying out their duties.18. To conduct any matter as required by other laws and regualtions.Where a fishing vessel has deployed a mate on board, the duty as referred to in sub-paragraph (1) of the preceding paragraph shall be conducted by the said mate.

船長負責全船之安全及管理事宜，其職掌如下：
一、出港前應確認船舶自動識別系統船載臺、船位回報系統、救生設備及漁航儀器設備等可正常使用且適航，並將應急指位無線電示標放置於指定位置後，始可出港。
二、出港前應清點船上膳食、飲用水及藥品是否足量；如有不足，應通報漁業人補充。
三、查核船員應攜帶有效之漁船船員手冊、外國籍船員證或幹部船員執業證書，並確認船員之體格檢查是否合格。
四、監督指揮全體船員綜理航行及漁撈作業，如漁船合組作業時，其從船船長應受主船船長之指揮。
五、漁場之選擇、作業位置之選定及漁撈技術之指導。
六、應熟知本船之構造與性能，並隨時注意安全檢查、保養及維修；卸任時，應將本船特性及有關紀錄告知並移交繼任之船長。
七、應要求船員於甲板上從事漁撈作業時穿著救生衣。
八、海上接獲他船之呼救，應立即施以救援。
但本船亦在危險狀態時，不在此限。
九、漁船於海上發生遇險、事故或船員發生傷病、落海、失蹤、死亡時，應立即通報漁業通訊電臺。
十、船員於海上發生重大傷病時，應儘速將漁船駛往就近港口就醫，或協調友船將該船員就近送醫。
十一、指派船員維護住艙、廚房、餐廳、廁所、浴室之清潔及使用。
十二、負責保管本船各項法定證明文件及船員名冊。
屬第七條第二項之漁船，應另保管勞動契約影本，並提供船員查閱。
十三、隨時記載，並查閱航海及作業日誌。
十四、對實習人員之指導及考核。
十五、海上遇有下列情事，應將事實始末、時間地點詳實記載於航海日誌，檢送最初到達港之航政及漁業主管機關：
（一）本船遭遇海難及危險事項。
（二）發現他船碰撞或遇難。
（三）救護遇難船隻或人命。
（四）對於船員過失處分。
（五）船上所載人員失蹤、死亡、傷害、染患傳染病。
（六）其他重要事項。
十六、依船員法第六十六條之規定作成海事報告。
十七、應提供觀察員及檢查員執行任務必要及充分之協助。
十八、其他依法令應辦理事項。
前項第一款所定事項，在置有船副之漁船，由船副辦理之。
