Regulations on the Authorization and Management of Overseas Employment of Foreign Crew Members Article 17

In case that any distant water fisheries operator that commissions an recruitment agent, or an recruitment agent itself, fails to fulfill the obligations set forth in the contract relating to the wages, insurance, medical care, transportation expenses, damage compensation, and other obligations owed to foreign crew members, and such operator or recruitment agent fails to discharge the debt or pay within the required timeframe after being notified by the competent authority, the competent authority may apply the guarantee bond submitted by such recruitment agent pursuant to Article 8 to satisfy such obligations.Where the guarantee bond is drawn upon pursuant to the preceding paragraph, the competent authority shall order the concerned recruitment agent to, within a prescribed time limit, replenish the bond to the amount specified in Article 8, paragraph 2.
