The Forestry Act Article 38
Should a forest be threatened or afflicted by biological organisms and their spread or protracted presence, the government agency may order the forest owner and other parties with interests in the forest to perform actions required for the elimination of said organisms or prevention of their spread.The cost of said elimination or prevention will be calculated based on the area and value of the land, and shall be borne by the forest owner. However, if a prior agreement has been made among those sharing such costs, the terms of the agreement shall preside.

森林生物為害蔓延或有蔓延之虞時，主管機關得命有利害關係之森林所有人，為撲滅或預防上所必要之處置。
前項撲滅預防費用，以有利害關係之土地面積或地價為準，由森林所有人負擔之。
但費用負擔人間另有約定者，依其約定。
