The Plant Variety and Plant Seed Act Article 14
To apply for a variety right, the applicant shall submit to the central competent authority a duly completed application form together with a written description of the variety and relevant supporting documents.The written description of the variety shall state the following matters:1. The name, domicile, and residence of the applicant, or in the case of a juridical person or organization, its name, office location or place of business, as well as the name, domicile, and residence of its legal representative or manager;2. The botanical taxon of the variety;3. The denomination of the variety;4. The source of the variety;5. The characteristics of the variety;6. The process of breeding and discovery of the variety;7. A test report on the cultivation of the variety;8. Matters to which one must pay attention when cultivating the variety; and9. Other related matters.A variety denomination shall be written in Chinese, together with the denomination in Roman letters. For varieties bred in foreign countries, the variety denomination shall be written in Roman letters and Chinese.

申請品種權，應填具申請書，並檢具品種說明書及有關證明文件，向中央主管機關提出。
品種說明書應載明下列事項：
一、申請人之姓名、住、居所，如係法人或團體者，其名稱、事務所或營業所及代表人或管理人之姓名、住、居所。
二、品種種類。
三、品種名稱。
四、品種來源。
五、品種特性。
六、育成或發現經過。
七、栽培試驗報告。
八、栽培應注意事項。
九、其他有關事項。
品種名稱應書以中文，並附上羅馬字母譯名。
於國外育成之品種，應書以其羅馬字母品種名稱及中文名稱。
