Enforcement Rules for Water Act Article 14-1
When reviewing the water yield under the surface water right, the authority-in-charge shall refer to the constantly maintained yield based on hydrological testing, the authorized downstream water yield under the surface water right, the use of water needed by an entity, and other necessary matters for approval.The constantly maintained yield referred to in the preceding paragraph refers to yield of surface water with flow exceedance probability of 85% or higher. The constantly maintained yield will be reviewed and updated by the authority-in-charge every five years.

主管機關審核川流水源之地面水權引用水量，應參酌引水地點之水文測驗所得水源通常保持之水量、其下游已核准地面水水權水量、申請人事業所需用水量及其他必要事項等覈實核給。
前項所稱水源通常保持之水量，指引水地點之流量超越機率百分之八十五之水量，並由主管機關每五年檢核更新之。
