Water Act Article 83-5
When developing the relevant industry, the executive agency shall apply the runoff allocation measures based on the runoff allocation plan prior to the land reserved for watercourses, drainage or public facilities or public land.When the land referred to in the preceding paragraph is unavailable, private land may be expropriated in accordance with the Land Expropriation Act.

執行機關興辦目的事業時，應依逕流分擔計畫辦理逕流分擔措施，並優先於水道用地、各類排水用地、公有土地或公共設施用地為之。
前項土地皆無法辦理而需用私有土地時，得依土地徵收條例相關規定辦理。
