Patent Act Article 75
Principle of ex officioWhen conducting invalidation proceedings, the Specific Patent Agency may, ex officio, examine the reasons and evidence not provided by the requester of the invalidation action but within the scope of the invalidation statement, and notify the patentee to respond within a specified time period. The invalidation proceedings shall be conducted accordingly if the patentee fails to respond within the time period.
