Sub-licensingAn exclusive licensee may sub-license a third party to exploit the licensed patent unless otherwise agreed upon by contract.A non-exclusive licensee shall not be allowed to sub-license a third party to exploit the licensed patent without the consent of the invention patentee or the exclusive licensee.The sub-licensing contract shall have no locus standi against any third party unless it is recorded with the Specific Patent Agency.

專屬被授權人得將其被授予之權利再授權第三人實施。
但契約另有約定者，從其約定。
非專屬被授權人非經發明專利權人或專屬被授權人同意，不得將其被授予之權利再授權第三人實施。
