Prison Act Article 36
Inmates who work shall receive labor wage.The calculation and payment of labor wage for work in the preceding paragraph shall be based on an allocated percentage of total amount of labor wage and allocated separately. The inmate’s actual work time and labor productivity shall be combined to calculate the payment amount. Regulations governing the settings of the allocation ratio, distribution, and relevant matters shall be prescribed by the Ministry of Justice.

參加作業者應給與勞作金。
前項勞作金之計算及給與，應將勞作金總額依比率分別提撥，並依受刑人實際作業時間及勞動能率合併計算給與金額。
其提撥比率設定及給與分配等相關事項之辦法，由法務部定之。
