A public official who sets free or facilitates the escape of any person under his custody shall be sentenced to imprisonment for not less than one year but not more than seven years.A public official who negligently commits an offense specified in the preceding paragraph shall be sentenced to imprisonment for not more than six months, short-term imprisonment, or a fine of not more than nine thousand dollars.An attempt to commit an offense specified in paragraph 1 is punishable.

公務員縱放職務上依法逮捕、拘禁之人或便利其脫逃者，處一年以上七年以下有期徒刑。
因過失致前項之人脫逃者，處六月以下有期徒刑、拘役或九千元以下罰金。
