Civil Code Article 743

A guaranty given for an obligation which is invalid on account of debtor's lack of capacity to make juridical acts is still valid, if the guarantor binds himself in spite of the knowledge of the fact.

保證人對於因行為能力之欠缺而無效之債務，如知其情事而為保證者，其保證仍為有效。
