Early Childhood Education and Care Act Article 49
The responsible person may not, in the capacity of a representative of an organization other than educare organization, hold a position on the consultation, evaluation, or appeals and arbitration committee for educare services.In the case of violation of the preceding Paragraph, the competent authority shall appoint another individual.The recusal of members of the evaluation or appeals and arbitration committee shall be handled in accordance with the applicable provisions of the Administrative Procedure Act.

負責人不得以非教保團體代表之身分，擔任教保服務諮詢會、審議會及申訴評議會之委員。
違反前項規定者，主管機關應重新聘任。
審議會、申訴評議會委員之迴避，依行政程序法之規定辦理。
