The Special Education Act Article 13
Preschools and schools up to and including the senior high level shall actively implement inclusive education, and strengthen interaction and collaboration between general education teachers and special education teachers.Preschools and schools up to and including the senior high level may establish special education classes, as follows:A. Resource rooms.B. Itinerant programs.C. Self-contained classes.Establishment of the special education classes in the previous paragraph shall be approved by the corresponding competent authorities, whereas its personnel and facilities are determined by the central competent authority.In the case students of preschools and schools up to and including the senior high level are not placed in the special education class based on the regulations in paragraph two in this Article, the schools involved may develop and apply for special education programs to the corresponding competent authorities; the regulations and autonomous enactments concerning the contents, procedures, and other matters relating to application are determined by the corresponding competent authorities.

高級中等以下學校及幼兒園應積極落實融合教育，加強普通教育教師與特殊教育教師交流與合作。
高級中等以下學校及幼兒園，得設特殊教育班，其辦理方式如下：
一、分散式資源班。
二、巡迴輔導班。
三、集中式特殊教育班。
前項特殊教育班之設置，應由各級主管機關核定；其班級之設施及人員設置標準，由中央主管機關定之。
高級中等以下學校及幼兒園未依第二項規定辦理者，得擬具特殊教育方案向各級主管機關申請；其申請之內容、程序與其他相關事項之辦法及自治法規，由各級主管機關定之。
高級中等以下學校及幼兒園，得設特殊教育班，其辦理方式如下：
