Regulations for Invitation to Tender and Award of Contract in Special Procurement Article 5
In conducting a procurement referred to in subparagraph 2 of paragraph 1 of Article 105 of the Act, an entity shall first affirm that there exist conditions that pose imminent danger to the life, body, health, or property of the people, and the necessity for carrying out an emergency procurement has been approved by the head of the entity or the personnel authorized by the head.The approval documents referred to in the preceding paragraph shall identify what provisions of the Act with respect to invitation to tender and award of contracts will not apply due to emergency. The provisions of the Act shall apply if no such identification was contained in the approval documents.

機關辦理本法第一百零五條第一項第二款之採購，應先確認人民之生命、身體、健康或財產遭遇緊急危難，且該採購業經機關首長或其授權人員核准確有緊急處置之必要。
前項核准文件應記載本法招標及決標規定中因緊急處置得不適用之條文；其未記載者，仍應適用本法之規定。
