Regulations for Exchange Between National Non-public Use Real Estate and Other Real Estate Article 12
If the exchange application case is found to comply with the regulations after examination, the executing authority should schedule a notification period for the applicant to negotiate and determine the exchange plan. The approved plan should then be submitted to the Ministry of Finance for approval. If negotiation fails or the applicant refuses to accept the approved result, the application will be canceled.When there are two or more applicants for the exchange of the same national real estate, the following procedures will be followed in the specified order. However, those applying under the provisions of Paragraph 2, Article 6 will be given priority:1. The one with the earlier application submission date.2. If the applications have the same submission date, a random draw will be conducted.

申請交換案件經審查符合規定者，執行機關應訂期通知申請人協商決定交換方案，層報財政部核定。
協商不成或申請人不接受核定結果者，註銷其申請案。
同一國有不動產有二人以上申請交換，依下列順序及方式處理。
但依第六條第二項規定申請交換者，優先處理之：
一、收件日期在先者。
二、收件時間為同一日者，以抽籤方式定之。
