Criminal Code of the Armed Forces Article 12
An act is not punishable when committed for maintaining the momentous profit on national defenses or military affairs in desperation. Provided, If the act was excessively improper, punishment may be reduced or remitted.

戰時為維護國防或軍事上之重大利益，當事機急迫而出於不得已之行為，不罰。
但其行為過當者，得減輕或免除其刑。
