Criminal Code of the Armed Forces Article 11
The Code shall apply to the period and area that the president declares the war according to the provisions of wartime, and as well as the period and districts under martial laws for the war or the revolt. If the Legislative Yuan doesn’t approve the proclamation of war or the martial law, this Code does not apply.
中文原文 陸海空軍刑法第11條
本法關於戰時之規定，適用於總統依憲法宣戰之期間及地域。
其因戰爭或叛亂發生而宣告戒嚴之期間及地域者，亦同。
但宣戰或戒嚴未經立法院同意或追認者，不在此限。
戰時犯本法之罪，縱經媾和、全部或局部有停火之事實或協定，仍依戰時之規定處罰。
但按其情節顯然過重者，得減輕或免除其刑。
