Armed Forces Disciplinary Punishment Act Article 11
A disciplinary offense is not punishable if it was committed by a servicemember at the time when he/she was mentally disordered or defective and, as a result, was unable to judge his/her act as in contravention of laws or lacked the ability to act in accordance with his/her judgment. The punishment may be reduced at discretion whereas a disciplinary offense was committed by a servicemember at the time the existence of the causes stipulated in the preceding paragraph contributes to the obvious reduction of the ability to judge his/her act as in contravention of laws or the lack of the ability to act in accordance with his/her judgment.Provisions prescribed in the two preceding Paragraphs shall not apply to a servicemember who, with intent or by negligence, causes the mental disorder or defects.
