Pay Act of the Armed Force Article 11
Paragraph 1An active military serviceman missing in action or in execution of duty shall be entitled for the full active service pay, and the pay shall be paid to his/her dependents in Taiwan; missing status other than preceding status shall be entitled for basic pay (basic wage).Paragraph 2An active service commissioned officer suspended other than missing status in the preceding paragraph shall be entitled half of its basic pay (basic wage) during his suspension.Paragraph 3A suspended active commissioned or noncommissioned officer due to involvement in a case , after review, investigation, and final judgment, without receiving an order of removal from office, and order of suspension from office, a settled ruling nolle prosequi, or an irrevocable final judgment of non-guilty, shall be paid the basic pay (basic wage) during the suspension period. If half of the basic pay (basic wage) has been paid to the suspended officers during the suspension period, the amount shall be deducted.Paragraph 4On the death of a suspended military serviceman, those who are entitled to relief may claim and receive the pay of the suspension period which has not been tendered.

現役軍人因作戰或執行公務失蹤，於未停役或未確定死亡前，仍依其現役待遇，發給在臺家屬；非因作戰或執行公務失蹤者，則發給本俸（薪額）。
因前項失蹤以外原因停職之現役軍官、士官，其停職期間，得發給本俸（薪額）之半數。
現役軍官、士官因案停職，經審議、偵查、審判終結，未受撤職、休職處分或經不起訴處分或判決無罪確定者，應補發其停職期間之本俸（薪額）。
但停職人員停職期間領有之半數本俸（薪額），應扣除之。
停職人員死亡者，得補發停職期間未發之本俸（薪額），並由依法得領受撫卹金之人具領之。
