Social Order Maintenance Act Article 45
Cases other than those mentioned in the first paragraph of Article 43 shall be referred to the summary court for a ruling after interrogation.The case referred by police authorities for a court ruling may be exempt from punishment or may be subject to other punishments imposed by the competent summary court if it finds this case should not be punished or punishments other than detention, suspension of business or termination of business is more appropriate.

第四十三條第一項所列各款以外之案件，警察機關於訊問後，應即移送該管簡易庭裁定。
前項警察機關移請裁定之案件，該管簡易庭認為不應處罰或以不處拘留、勒令歇業、停止營業為適當者，得逕為不罰或其他處罰之裁定。
